Approve Agreement with Eide Bailly, LLP, to provide a performance audit of the Non‐Financial Hardship Project No. 50/67843‐00‐009, Mission Elementary School, New Construction for a cost of $6,000.00, to be funded by Developer Fee Funds (Appendix Item).

Eide Bailly, LLP, will perform the required performance audit of the Non‐Financial Hardship Project No. 50/67843‐00‐009, Mission Elementary School, New Construction, in accordance with the compliance requirements of Section 8 of Article II of the California Constitution (Proposition 51).

c.
Approve Agreement, with John R. Byerly, Inc. for Geotechnical, Testing Laboratory and Special Inspection Services for Fabrication and Installation of Field Lighting Poles for the Redlands East Valley High School Stadium Project, for a cost of $14,780.00, to be funded by Developer Fee Funds. Authorize Jason Hill, Assistant Superintendent, Business Services, to sign on behalf of the Board (Appendix Item).

Byerly will provide the required testing and inspection services for the fabrication and installation of field lighting poles on the REV Stadium Project.

d.
Approve Agreement with the Redlands Educational Partnership (REP), for the District to act as a fiscal agent for the After School Educational and Safety (ASES) Grant, to forward proceeds to REP to fund the program agreement between REP and the YMCA of the East Valley, effective August 10, 2022 through June 30, 2023 (Appendix Item).

The Redlands Educational Partnership is contracting with the YMCA of the East Valley to provide staffing for the After School Education and Safety grant from the CDE.  The YMCA, as a community organization, brings its 100+ years of experience in serving youth to the students in Redlands schools.  Local, family-oriented, and well-experienced, the Y staff will help the ASES program reach a new level of success by driving grant-funded dollars toward direct services to students without the need for large amounts of overhead. All of the ASES programs have shown they benefit from the collaborative partnerships the AAA Academy director cultivates with them and with partnering agencies such as the University of Redlands Community Engagement Program, Girl Scouts, Inland Empire Resource Conservation District, Climate Action Corp, TreeStock, Redlands Police Department, Redlands Community Center, and the Burrage Buddies Program of the Rochford Foundation. Equally, the YMCA brings many more partners to the ASES sites that will result in enhanced opportunities for our students.

Approve Amendment No. 1 with Inland Inspections & Consulting, DSA Inspection Services for the Switchgears Removal and Replacement at Redlands High School, for an increase of $15,000.00, and to extend the agreement to June 30, 2023. Authorize Jason Hill, Assistant Superintendent, Business Services, to sign on behalf of the Board (Appendix Item).

On July 13, 2021, the Board approved the agreement with Inland Inspections & Consulting for DSA Inspection Services for the Switchgears Removal and Replacement at Redlands High School.  Fee increase is needed as two additional switchgears were discovered by the electrical contractor, requiring additional hours of DSA inspection services.  This amendment will also extend the contract date to June 30, 2023.

f.
Approve Amendment No. 1 with NV5 West, Inc., for DSA Special Inspections and Testing Services for the Redlands High School Switchgear Replacement Project, for an increase of $19,035.25, to extend the agreement to June 30, 2023. Authorize Jason Hill, Assistant Superintendent, Business Services, to sign on behalf of the Board (Appendix Item).

On March 8, 2022, the Board approved the agreement with with NV5 West, Inc., for DSA Special Inspections and Testing Services for the Redlands High School Switchgear Replacement Project. A fee increase is needed as two additional switchgears were discovered by the electrical contractor, requiring additional testing and inspections.  This amendment will also extend the contract date to June 30, 2023.

g.
Ratify/Approve Agreement with Autism Therapies, LLC to provide Direct Service, BCBA Supervision, and IEP Meeting Attendance as directed by the District, to be billed per attached Rate Sheet, effective July 1, 2022 through June 30, 2023, to be funded by Special Day Aides Funds (Appendix Item).

The District must provide intensive aide support (Direct Service) and BCBA Supervision to students as required by students’ individualized education programs (IEPs). Supervising BCBA may also be required to attend IEP meetings to discuss progress, efficacy of interventions, and need for support. Consultant is specially trained, experienced, and qualified to provide these services. District shall direct the provision of Consultant’s services and Consultant shall bill District for services at Consultant’s agreed upon rates.

h.
Ratify/Approve Consultant Agreement between Redlands Unified School District and Boys & Girls Club of Greater Redlands-Riverside, to provide comprehensive management and supervision services for students attending the before and after school ELOP program each day; effective August 10, 2022 through June 30, 2023, funded by ELOP and NTE $500,000.00 (Appendix Item).

Boys & Girls Club of Greater Redlands-Riverside is committed to providing activities consistent with expanded learning opportunities while providing a safe physical and emotional environment, opportunities for relationship building, and promotion of active student engagement through the following required elements: an educational and literacy element, which can include time for homework; an educational enrichment element; an organized recreation (physical activity) element; and time for a snack/meal.

i.
Ratify/Approve Agreement with Citrus Counseling Services, Inc. to provide mental health services to students, effective July 1, 2022 through June 30, 2023, at a cost not to exceed $15,000.00, to be funded by Local Control Accountability Plan Funds (Appendix Item).

In partnership with Redlands Unified School District (RUSD), Citrus Counseling Services (CCS) provides mental health and psychoeducational services to students. These services are utilized to fill the service gap for students who are experiencing mental health concerns (such as anxiety, depression, or suicidal ideation) who do not qualify for state and county funded programs. Referred students receive a screening to assess for state or county funded programs qualification. If the student qualifies, CCS provides services and bills the state or county. If the student does not qualify, they are offered services utilizing the student’s insurance coverage or to pay out of pocket. In the event that students need to receive care as soon as possible, and are not able to access services through non-district funding sources (county funded programs, their insurance, or cannot play out of pocket), RUSD authorizes funding for mental health services for the student based on the clinical need.

j.
Ratify/Approve Agreement with Clay Counseling Foundation, to provide mental health services to students, effective July 1, 2022 through June 30, 2023, at a cost not to exceed $15,000.00, to be funded by Local Control Accountability Plan Funds (Appendix Item).

These services are utilized to fill the service gap for students who are experiencing mental health concerns (such as anxiety, depression, or suicidal ideation) who do not qualify for state and county funded programs. Referred students receive a screening to assess for state or county funded programs qualification. If the student qualifies, Clay Counseling Foundation provides services and bills the state or county. If the student does not qualify, they are offered services utilizing the student’s insurance coverage or to pay out of pocket. In the event that students need to receive care as soon as possible, and are not able to access services through non-district funding sources (county funded programs, their insurance, or cannot play out of pocket), RUSD authorizes funding for mental health services for the student based on the clinical need.

k.
Ratify/Approve Agreement with RISE Interpreting Services, to provide Instructional Signing Aides as directed by the District, at a cost to be billed per attached Rate Sheet, effective September 14, 2022 through June 30, 2023, to be funded by Special Day Aides Funds (Appendix Item).

The District must provide instructional ASL aides to students as required by students’ individualized education programs (IEPs). Consultant is specially trained, experienced, and qualified to provide these services. District shall direct the provision of Consultant’s services and Consultant shall bill District for services at Consultant’s agreed upon rates.

l.
Ratify/Approve Agreement with Salinas Family Counseling, to provide mental health services to students, effective July 1, 2022 through June 30, 2023, at a cost not to exceed $15,000.00, to be funded by Local Control Accountability Plan Funds (Appendix Item).

In partnership with Redlands Unified School District (RUSD), Salinas Family Counseling provides mental health and psychoeducational services to students. In the event that students need to receive care as soon as possible, and are not able to access services through non-district funding sources (county funded programs, their insurance, or cannot play out of pocket), RUSD authorizes funding for mental health services for the student based on the clinical need.

m.
Ratify/Approve Memorandum of Understanding with South Coast Community Services, to provide Student Assistance Program (SAP) counseling services at District school sites, effective July 1, 2022 through June 30, 2023, at no cost to the District (Appendix Item).

South Coast Community Services (SCCS) provides mental health services funded through various sources from the County of San Bernardino including the Student Assistance Program (SAP), Community Wholeness & Enrichment (CWE), School Aged Treatment Services (SATS), Success First (SF), Therapeutic Behavioral Services (TBS), and Wraparound. These programs provide various services including, but not limited to, Prevention/ Early Intervention services such as education-based and supportive groups (anger management, self-esteem, bullying prevention, girl/boy empowerment, and self-advocacy), mental health treatments/therapeutic services, and psycho education.

n.
Ratify/Approve Renewal with Super Co-Op to provide USDA Food cooperative, effective July 1, 2022 through June 30, 2023, at a cost not to exceed $15,000.00, to be funded by Child Nutrition Services Funds (Appendix Item).

The Super Co-Op is a USDA Foods cooperative operating in California since 2001. Membership for the 2022-2023 school year consists of 230 districts with a $78.4 million USDA Foods entitlement based on an estimated 233.9 million lunches served.  It is the largest foods group in the nation. Redlands Unified School District entered into an agreement with the Super Co-Op to better utilize drawing commodities from all areas and to enhance tracking.

o.
Ratify/Approve the Compromise Agreement between Redlands Unified and the family of student A.B., effective upon approval by the Board, to be funded by District General Funds and Special Education Administration Funds (Appendix Item).

There is presently a dispute between the parties regarding the student's educational program. Petitioner contends that the educational program denied the student a free appropriate public education (FAPE). The District contends that it made a FAPE available to the student. To resolve this dispute, the Petitioner and the District have negotiated a compromise. The Compromise Agreement requires approval by the District's Governing Board, and the District has submitted the Agreement for approval at the first available District Board of Education Meeting.

p.
Approve Change Order No. 6 with Cornerstone Construction Service, Inc., Sitework for Relocatables at Cope Middle School, Bid 1-22, in the amount of $11,856.63 to be funded by Developer Fees (Appendix Item).

This change order is for Bid 1-22, Sitework for Relocatables at Cope Middle School, which the Board awarded on July 27, 2021.  This change order addresses unforeseen conditions and contains an explanation of the reason for the change order, the amount, and the amended contract amount.  

q.
Extend Award RFP 6-22 for Produce, to the lowest responsible/responsive bidder, Harvest Produce Inc., effective September 14, 2021, to be funded by Child Nutrition Services Funds. This extension is for one year, and may be extendable up to three years, not exceeding a total of four years. Authorize Jason Hill, Assistant Superintendent, Business Services, and Amy Drummond, Purchasing Director I, to sign related documents on behalf of the Board.

RFP number 6-22 for Produce will supply fresh produce for meals/snacks distributed by Child Nutrition Services. RFP opened on August 5, 2021 at 10:00 a.m.

Ratify/Approve Attendance at Professional Meetings (Appendix Item).

s.
Approve Payment Transmittal Numbers 23000119 through 23000295 for September 13, 2022, in the amount of $10,863,845.45. Authorize Jason Hill, Assistant Superintendent, Business Services, to sign on behalf of the Board (Appendix Item).

XIII.
BUSINESS SERVICES ACTION ITEMS
a.
Approve the Final 2021-2022 Unaudited Actual Financial Report pursuant to Education Code 42100. Authorize Jason Hill, Assistant Superintendent, Business Services, to sign on behalf of the Board (Appendix Item).

The Unaudited Actuals report is the District's 2021-2022 financial statements for each fund for the period ending June 30, 2022.  Education Code Section 42100 requires the Governing Board of each district to approve an annual statement of all receipts and expenditures of the district for the preceding fiscal year and file the statements with the Superintendent of Public Instruction (SPI). Included in this report, are actual revenues and expenditures for the 2021-2022 fiscal year ending June 30, 2022.  The financial report will be audited by the District’s independent audit firm, Eide Bailly, pursuant to Education Code 41020.

b.
Adopt Resolution No. 12, 2022-23, Resolution for Adopting the “Gann Limit” (Appendix Item).

Education Code Sections 1629 and 42123 specify that the District Governing Boards shall adopt a resolution identifying their annual estimated appropriations limit for the current year and their actual appropriations limit for the preceding year.  The documentation used in this identification of the appropriation limits shall be made public.

c.
Adopt Resolution No. 17, 2022-2023, Resolution Continuing Authority to Hold Virtual Meetings Pursuant to AB 361 (Appendix Item).

AB 361 now requires the Board to make findings justifying continuing to hold virtual Board meetings within 30 days of the first virtual meeting after October 1, and every 30 days thereafter.  This Resolution establishes the status of the ongoing state of emergency due to the COVID-19 pandemic and authorizes the Board to continue to hold virtual meetings as necessitated by health and safety concerns and/or State or local health orders.

EDUCATIONAL SERVICES CONSENT ITEMS
a.
Approve all Consent Items as detailed in Items XIV.b. - XIV.m.

b.
Approve Redlands Unified School District’s 2022-2023 Consolidated Application for Funding to the State Department of Education (Appendix Item).

Participation in the following list of programs is requested via this application process: Title I, Part A (Basic Grant); Title II, Part A (Supporting Effective Instruction); Title III English Learner; and Title IV, Part A (Student and School Support).

c.
Approve Agreement between the University of Redlands and Redlands Unified School District to participate in two Off-Campus Work-Study Programs for the 2022-23 school year. Effective September 14, 2022 through December 31, 2022, students will earn $14.75 per hour and the employer (school site) is reimbursed 70% of the students’ gross earnings. Effective January 1, 2023, students will earn $15.50 per hour. Most sites pay their small share with School Site Plan Funds. Authorize Sonya Balingit, Director, Multilingual Programs & Family Engagement, to sign on behalf of the governing Board (Appendix Item).

These programs are designed to provide eligible students enrolled in post-secondary education with the opportunity to earn money to help defray their educational costs while gaining experience in educationally beneficial or career-related employment.

d.
Approve Revised Memorandum of Understanding between the University of La Verne and the Redlands Unified School District to create and support a college preparation and guaranteed admission program for all incoming ninth grade students beginning with the 2022-2023 school year. Authorize Ken Wagner, Assistant Superintendent, Educational Services, to sign on behalf of the Board (Appendix Item).

The MOU between the Redlands Unified School District and the University of La Verne creates a formal commitment to the support of District students qualifying for admission to the University of La Verne. The MOU provides for a system of support for RUSD students to meet the admission requirements for entrance into La Verne upon graduation without need for remedial courses.

e.
Ratify/Approve Amendment No. 1 to the Agreement with the Office of the San Bernardino County Superintendent of Schools for Consultant Services with “Give Something Back”, to provide monthly group mentoring sessions for foster youth, homeless youth, and other system-involved youth at all four middle schools and all four high schools, effective March 1, 2022 through June 30, 2023, at no cost to the District. Authorize Ken Wagner to sign on behalf of the Board (Appendix Item).

This agreement was initially Board approved on March 8, 2022; however, this amendment is extending the agreement through June 30, 2023. The Office of the San Bernardino County Superintendent of Schools has received grant funding to provide mentoring services and support to underserved and at-risk students.  “Give Something Back” will conduct once a month visits at each of our secondary schools, promoting developmental themes to encourage these youth and empower them to meet the challenges of being successful students and citizens as they grow through the challenges of being historically underserved or being considered at-risk.

f.
Approve Revised Board Policy and New Administrative Regulation 6152.1 – Placement In Mathematics Courses [Second Reading] (Appendix Item).

The revisions to this Board Policy and adoption of this new Administrative Regulation will bring them current with California School Boards Association (CSBA) guidelines, Education Code and/or Legislation.

Ratify/Approve 13 Members of Boys Varsity Water Polo to travel, by car, to Santa Barbara, CA to compete in the Invitational Tournament of Champions, effective September 8, 2022 through September 10, 2022.

To be funded by ASB; Two days of school will be missed.

Approve 15 Members of Girls Varsity Volleyball from Redlands High School to travel, by car, to La Jolla, CA to compete in the La Jolla Bishops Volleyball Tournament, effective September 16, 2022 through September 17, 2022.

To be funded by Volleyball Boosters; One day of school will be missed.

i.
Approve 75 Members of Marching Band from Citrus Valley High School to travel, by bus, to San Clemente and Anaheim, CA, to compete in the Field Tournament and participate in the Disneyland Parade, effective November 5, 2022 through November 6, 2022.

To be funded by ASB; Zero days of school will be missed.

j.
Approve 15 Members of Girls Varsity Volleyball from Redlands High School to travel, by car, to San Diego, CA to compete in the West Valley High School Volleyball Tournament, effective November 7, 2022 through November 8, 2022.

To be funded by Volleyball Boosters; One day of school will be missed.

k.
Approve 50 AVID Juniors from Redlands High School to travel, by bus, to Northern California, for the purpose of touring prospective colleges and universities, effective November 9, 2022 through November 12, 2022.

To be funded by ASB; Three days of school will be missed.

l.
Approve 50 Sixth Grade Students from Cope Middle School to travel, by bus, to Angelus Oaks, CA, to participate in an inclusive educational program to Science Camp, effective April 11, 2023 through April 14, 2023.

To be funded by ASB; Four days of school will be missed.

m.
Approve 120 Members of Orchestra from Citrus Valley High School to travel, by bus, to Wilmington, CA and then, by ship, to Baja California to participate in the International Cruise Festival, effective May 26, 2023 through May 28, 2023.

To be funded by ASB; One half-day of school will be missed. Students/Chaperones will not disembark.

EDUCATIONAL SERVICES ACTION ITEMS
a.
Adopt Resolution No. 11, 2022-2023, Statement of Assurance, Pupil Textbook and Instructional Materials Compliance, for Grades TK-12, for fiscal year 2022-2023 (Appendix Item).

Redlands Unified School District must comply with the requirements of Education Code Section 60119, which states each pupil, including English learners, were provided sufficient textbooks and instructional materials aligned to the academic content standards and consistent with the cycles and content of the curriculum frameworks in Mathematics, Science, History-Social Science, and English Language Arts. This resolution is to provide assurance for all Redlands Unified School District schools.

b.
Approve request for readmission of student 2021-2022-008 following expulsion effective November 16, 2021, through the remainder of the first semester and all of second semester of the 2021-2022 school year.

Student 2021-2022-008 was recommended for expulsion in violation of Education Code 48915 (a5) Assault/ battery of staff. The student has met all conditions of the expulsion order and is eligible for readmission for the first semester of the 2022-2023 school year.  

c.
Approve request for readmission of student 2021-2022-013 following expulsion effective December 3, 2021, through the remainder of the first semester and all of second semester of the 2021-2022 school year.

Student 2021-2022-013 was recommended for expulsion in violation of Education Code 48900.7 Pupil has made terrorist threats against school officials, school property, or both. The student has met all conditions of the expulsion order and is eligible for readmission for the first semester of the 2022-2023 school year.  

d.
Approve request for readmission of student 2021-2022-014 following expulsion effective December 15, 2021, through the remainder of the first semester and all of the second semester of the 2021-2022 school year.

Student 2021-2022-014 was recommended for expulsion in violation of Education Code 48900.7 Pupil has made terrorist threats against school officials, school property, or both. The student has met all conditions of the expulsion order and is eligible for readmission for the first semester of the 2022-2023 school year.

Approve request for readmission of student 2021-2022-012 following expulsion effective November 15, 2021, through the first semester and all of second semester of the 2021-2022 school year.

Student 2021-2022-012 was recommended for expulsion in violation of Education Code 48900 (a2) Willfully used force or violence upon the person of another, except in self-defense. The student has met all conditions of the expulsion order and is eligible for readmission for the first semester of the 2022-2023 school year.

Approve the Stipulated Expulsion regarding student 2022-2023-001, expulsion through the remainder of the first semester and all of the second semester of the 2022-2023 school year, with the second semester suspended.

Student 2022-2023-001 was recommended for expulsion in violation of Education Code 48900 (a1) Caused, attempted to cause, or threatened to cause physical injury to another person.

Approve request for readmission of student 2019-2020-025 following expulsion effective December 6, 2019, for a full calendar year with the first semester of the 2020-2021 school year suspended.

Student 2019-2020-025 was recommended for expulsion in violation of Education Code 48900 (a1) Caused, attempted to cause, or threatened to cause physical injury to another person. The student has met all conditions of the expulsion order and is eligible for readmission for the first semester of the 2022-2023 school year.

COMMUNITY INPUT
This is the time that any member of the public may address the Board on any agenda item before or during the Board's consideration of the item, provided the person submits a completed Registration Card to Address the Board form to the Clerk of the Board or his/her designee prior to the time the Chairperson calls the item for the Boards consideration. This is not meant to be a debating period. Complaints and problems relating to policy matters will be referred to the Superintendent. 
The person wishing to address the Board shall, when recognized by the Chairperson of the Board, step up to the podium/microphone and announce his/her name. The Chairperson shall, in the interest of facilitating the business of the Board, limit the amount of time which a member of the public may use in addressing the Board to three [3] minutes, unless the Chairperson, or a majority of the Board determines that a different limit is appropriate.
