VII.

COMMUNITY INPUT FOR AGENDIZED ITEMS
This is the time that any member of the public may address the Board on any agenda item before or during the Board's consideration of the item, provided the person submits a completed Registration Card to Address the Board form to the Clerk of the Board or his/her designee prior to the time the Chairperson calls the item for the Boards consideration. This is not meant to be a debating period. Complaints and problems relating to policy matters will be referred to the Superintendent. 
The person wishing to address the Board shall, when recognized by the Chairperson of the Board, step up to the podium/microphone and announce his/her name. The Chairperson shall, in the interest of facilitating the business of the Board, limit the amount of time which a member of the public may use in addressing the Board to three [3] minutes, unless the Chairperson, or a majority of the Board determines that a different limit is appropriate.

PUBLIC HEARING
1.
Public Hearing regarding Redlands Unified School District’s 2023 Local Control and Accountability Plan (LCAP) (Appendix Item).

A draft copy of the Local Control and Accountability Plan will be available for public inspection beginning Monday, May 22, 2023, at the District Office, Educational Services Division, and at the secretary’s desk at the Board meeting. The plan can also be found on the District’s website at: www.redlandsusd.net.

2.
Public Hearing on Redlands Unified School District’s 2023-24 Annual Budget (Appendix Item).

The 2023-24 Budget per Education Code 42127 and Assembly Bill 1200, must be approved on or before July 1 per the District’s decision to utilize the single budget adoption cycle. The proposed budget will be available for public inspection beginning Friday, May 26, 2023, in the District’s Business Services Office during business hours.

3.
Public Hearing regarding the adoption of the following instructional materials for grades Preschool through Transitional Kindergarten (TK), to be implemented beginning the 2023-24 school year: Scholastic, PreK on My Way! (Appendix Item).

A teacher work group consisting of Redlands Unified School District preschool and transitional kindergarten (TK) teachers recommended “PreK on My Way!” instructional materials by Scholastic for RUSD’s preschool and transitional kindergarten (TK) classrooms. The teacher work group has verified that the selected instructional materials address the value of play and use of play-based approaches to build the skills children need to succeed in school and life, supporting children of all abilities, skill levels, and backgrounds. Materials have been on display for public review beginning May 12, 2023 through May 23, 2023.

BUSINESS SERVICES CONSENT ITEMS
a.
Approve all Consent Items as detailed in Items XII.b. – XII.q.

b.
Approve Agreement with the Law Offices of Atkinson, Andelson, Loya, Ruud & Romo, to provide legal services pertaining to District business, effective July 1, 2023 through June 30, 2024, unless renewed or extended by a written agreement. Billed per agreed-upon rates and to be funded by Business Services, CFD, Developer Fees and General Funds (Appendix Item).

The Law Offices of Atkinson, Andelson, Loya, Ruud & Romo, will provide legal services pertaining to District business and related matters as may be specifically directed by the Governing Board and the Superintendent/designee, including, but not limited to, personnel, labor, employee relations and other consortium-related services in addition to other services including facilities, special education, charter schools, and board/governance, or such other legal issues as may be specifically assigned by the Superintendent/designee.

c.
Approve the Master Agreement for Programs and Services between the Redlands Unified School District and the Colton-Redlands-Yucaipa Regional Occupational Program (CRY-ROP), effective July 1, 2023 through June 30, 2024. Authorize Patrick Kelley, Interim Superintendent, to sign on behalf of the Board (Appendix Item).

The Colton-Redlands-Yucaipa Regional Occupational Program (CRY-ROP) accelerates the skill development and education of high school students in the region to prepare them to be career ready, technically skilled and academically prepared. This agreement, pursuant to Education Code 52300 et seq., provides for a cooperative agreement with the CRY-ROP districts to establish and maintain programs for the purpose of providing career technical education and services to the students of the participating districts.

d.
Approve Agreement with Nicole Miller & Associates, Inc., to provide professional legal investigation services, effective July 1, 2023 through June 30, 2024, at a cost of $250.00 per hour, not to exceed $75,000.00, to be funded by General Funds (Appendix Item).

Nicole Miller & Associates, Inc., is a full-service independent investigative firm serving California’s educational institutions. Nicole Miller & Associates will provide legal investigative services for Redlands Unified School District. 

e.
Approve Letter of Understanding with Redlands Community Hospital to provide Tuberculosis Screenings and/or Risk Assessments to District employees, effective July 1, 2023 through June 30, 2024, at a rate of $15.00 for each administered injection or assessment, and $2.50 for injections ordered and not used, not to exceed $15,000.00 per year, to be funded by District General Funds (Appendix Item).

Board Policies and Administrative Regulations 4112.4, 4212.4 and 4312.4 – Health Examinations state that new and current District employees shall undergo periodic tuberculosis tests in accordance with law (Education Code 49406).

f.
Approve Amendment No.1 to an existing agreement with Cooperative Personnel Services (CPS), to extend the contract dates from April 30, 2023 to June 30, 2023, with an updated salary structure and normalization of salary rates, not to exceed $3,990.00 and to be funded by Business Services Funds (Appendix Item).

On June 14, 2022, the Board approved the agreement with Cooperative Personnel Services (CPS Consulting), to conduct a Base Salary Study, to assess and update the Redlands Unified School District Classified Salary Structure to ensure consistent bandwidth, midpoint separation, and consistent percentages between salary ranges and salary steps. 

g.
Approve Amendment No. 6 to Contract No. 18-640 A-6 with the San Bernardino County Sheriff Department for services rendered by the School Resource Officer, effective July 1, 2023 through June 30, 2024, at a total cost not to exceed $288,329.00, to be funded by Safety Funds. Authorize Patrick Kelley, Interim Superintendent, to sign on behalf of the Board (Appendix Item).

The San Bernardino County Sheriff's Office will provide one full-time Resource Officer (SRO) to be housed at Redlands East Valley High School. Amendment No. 6 will extend the current agreement to June 30, 2024.  

h.
Approve Notice to Exercise Third Option to Extend the Lease Term for a period of one (1) year with Mountain View Child Care, Inc., dba Totally Kids Rehabilitation Hospital, to be billed monthly in the amount of $5,009.02, effective July 1, 2023 through June 30, 2024, to be funded by Special Education Funds (Appendix Item).

Mountain View Child Care leases a 1,638 square foot classroom area at the sub-acute facility located at 1720 South Mountain View Avenue, Loma Linda to the District to be used as a classroom to provide educational instruction, educational services, program planning and related services for children who are being cared for by Totally Kids, Inc. The District began leasing space at the facility in 2009.

i.
Ratify/Approve Agreement with Kelsoe & Associates, Inc., for Land Surveying Services for the Redlands East Valley High School Stadium Project 2, at a cost of $17,970.00, to be funded by Developer Fees. Authorize Jason Hill, Assistant Superintendent, Business Services to sign on behalf of the Board (Appendix Item).

Kelsoe will provide land surveying services on the Redlands East Valley High School Stadium Project 2, including a control survey, field topography, mapping and additional surveying as needed.

j.
Approve Reject Claim Number 622202 in accordance with Government Code Section 913.

k.
Award Bid 12-23 for Instructional Supplies, ordered on an as-needed basis for warehouse stock, as listed on the Bid Matrix, effective immediately for one year and extendable up to three years. Authorize Jason Hill, Assistant Superintendent, Business Services, and Amy Drummond, Purchasing Director I, to sign related documents on behalf of the Board (Appendix Item).

This bid will provide instructional supplies for warehouse stock as needed, based on the District’s estimated warehouse usage per line item. Bid opened on February 28, 2023, at 10:00 a.m.

l.
Ratify/Approve the use of Velocity Truck Centers for Bid 18-23, in the absence of a formal bid, to purchase new vehicles and trade in current vehicles for Child Nutrition Services, to be funded by Child Nutrition Services Funds. Authorize Patrick Kelley, Interim Superintendent, Jason Hill, Assistant Superintendent, Business Services, and Amy Drummond, Purchasing Director I, to sign related documents on behalf of the Board.

Authorization of the Board is required for the use of Velocity Truck Centers for new vehicles to be purchased and current used vehicles to be traded in, due to the absence of a formal bid.  

m.
Approve Change Order No. 1 with Silver Creek Industries, for Purchase and Installation of Division of the State Architect approved portable buildings at Redlands High School, Piggy Back Bid - Centralia School District Bid CEPU#N15-2017/18 in the amount of $1,337.45 to be funded by Developer Fees and/or Redevelopment Agency Funds (Appendix Item).

This change order is for Piggy Back Bid - Centralia School District Bid CEPU#N15-2017/18, the Purchase and Installation of Division of the State Architect approved portable buildings at Redlands High School which the Board awarded on February 9, 2021. This change order addresses needed modifications due to changes in the scope of work.

n.
Approve Change Order No. 1 with Wakeco, Inc., for HVAC Upgrades at the District Office, Bid 6-23, in the amount of $148,047.11, to be funded by Covid and/or Redevelopment Agency Funds (Appendix Item).

This change order is for Bid 6-23, for HVAC Upgrades at the District Office, which the Board awarded on December 13, 2022. This change order addresses unforeseen conditions and contains an explanation of the reason for the change order, the amount, and the amended contract amount.  

o.
Accept donations. Instruct the secretary to write letters of appreciation on behalf of the Board (Appendix Item).

p.
Approve Payment Transmittal Numbers 23001490 through 23001571 for May 23, 2023, in the amount of $4,321,617.16. Authorize Jason Hill, Assistant Superintendent, Business Services, to sign on behalf of the Board (Appendix Item).

q.
Ratify/Approve Attendance at Professional Meetings (Appendix Item).

XIII.
BUSINESS SERVICES ACTION ITEMS
a.
Adopt Resolution No. 36, 2022-2023, finding the purchase of real property exempt from the California Environmental Quality Act and approving the purchase of real property located at 304 9th Street, City of Redlands, County of San Bernardino, California, 92374, Assessor Parcel Number (APN) 0169-321-02-0000 and 0169-321-02-100 for the estimated cost of $12,000,000.00 to be paid with a Certificate of Participation and from Redevelopment Funds (Appendix Item).

Redlands Unified School District wishes to acquire an approximately 67,203 square foot multi-structure food processing facility on approximately 4.6 acres located at 304 9th Street, City of Redlands, County of San Bernardino, California, 92374, Assessor Parcel Number (APN) 0169-321-02-0000 and 0169-321-02-1001 from its current owner, REDLANDS FOOTHILL GROVES INC. (“Seller”). District staff asks the Board to approve the purchase of the Property by approving the Agreement for Purchase and Sale and Joint Escrow Instructions negotiated by staff with Seller and the certificate of acceptance, which is attached to the resolution pursuant to Government Code section 27281 (“Purchase Agreement”). Additionally, the District must comply with the California Environmental Quality Act (“CEQA”) Public Resources Code section 21000 et seq. with respect to the purchase of the Property (“Project”). The Project involves negligible or no expansion of use of the Property. If the District commits to any development of the Property in the future the District will comply with CEQA applicable to said development. Thus, District staff has determined that the Project qualifies for a categorical exemption under Title 14 of the California Code of Regulations Section 15000 et seq. (“CEQA Guidelines”) Existing Facilities, Section 15301 (Class 1) which exempts projects that involve negligible or no expansion of use and is also exempt pursuant to CEQA Guidelines Section 15061(b)(3) which exempts projects from CEQA it can be seen with certainty that there is no possibility that a project may have a significant effect on the environment. District staff has also determined that that none of the exceptions to categorical exemption set forth in CEQA Guidelines Section 15300.2 apply. Adoption of the Resolution before the Board will result in the filing of a Notice of Exemption in accordance with CEQA.

EDUCATIONAL SERVICES CONSENT ITEMS
a.
Approve Consent Item as detailed in Item XIV.b. – XIV.d.

b.
Approve Redlands Adult School Schedule of Classes for the 2023-2024 school year, effective August 2023 through June 2024 (Appendix Item).

All programs, courses, and classes conducted as adult education shall be open to adults and listed in the school district's catalog of adult education classes provided to the public and shall be under the supervision and jurisdiction of the adult education administrator as determined by the Governing Board of the School District (Education Code 52523(a)).

c.
Approve three (3) members of Track & Field from Redlands East Valley High School to travel, by car, to Clovis, CA to participate in the State Track & Field Competition, effective May 25, 2023 through May 27, 2023.

To be funded by ASB; Two days of school will be missed.

d.
Approve six (6) members of Student Government from Redlands High School to travel, by car, to Santa Barbara, CA to attend the California Association of Directors of Activities (CADA) Leadership Camp, effective July 22, 2023 through July 25, 2023.

To be funded by ASB; Zero days of school will be missed.

XV.
EDUCATIONAL SERVICES ACTION ITEMS
a.
Approve the Adoption of “Scholastic, PreK on My Way!” instructional materials for grades Preschool through Transitional Kindergarten (TK), to be implemented beginning the 2023-2024 school year.

Approve the Stipulated Expulsion regarding student 2022-2023-036, expulsion through the remainder of the second semester for the 2022-2023 school year and all of first semester for the 2023-2024 school year, with the first semester for the 2023-2024 school year suspended.

Student 2022-2023-036 was recommended for expulsion in violation of Education Code 48915 (A5) Assault/ battery upon any school employee. 

c.
Approve the Stipulated Expulsion regarding student 2022-2023-037, expulsion through the remainder of the second semester for the 2022-2023 school year and all of first semester for the 2023-2024 school year.

Student 2022-2023-037 was recommended for expulsion in violation of Education Code 48900.4 (R) Intentionally engaged in harassment, threats, or intimidation against a pupil, groups of pupils, or staff; and 48900 (a1) Caused, attempted to cause, or threatened to cause physical injury to another person. 

d.
Approve the Stipulated Expulsion regarding student 2022-2023-038, expulsion through the remainder of the second semester for the 2022-2023 school year and all of first semester for the 2023-2024 school year.

Student 2022-2023-038 was recommended for expulsion in violation of Education Code 48900 (a1) Caused, attempted to cause, or threatened to cause physical injury to another person. 

e.
Approve the Stipulated Expulsion regarding student 2022-2023-039, expulsion through the remainder of second semester for the 2022-2023 school year and all of first semester for the 2023-2024 school year.

Student 2022-2023-039 was recommended for expulsion in violation of Education Code 48900 (c) Possessed, used, sold, or otherwise furnished, or been under the influence of any controlled substance (marijuana).
